Terms of Service

1. Acceptance of Terms

By accessing or using AME Foresight ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions, you may not access or use the Service.

2. Description of Service

AME Foresight provides an online platform that allows users to search for, view information about, and rate Aviation Medical Examiners (AMEs) and Designated Pilot Examiners (DPEs). The Service includes publicly available information from FAA databases, user-generated ratings and reviews, free examiner profile claims, and optional paid or complimentary Enhanced Profile features.

3. User Accounts

3.1 Registration

To access certain features of the Service, you may need to create an account. You must provide accurate, complete, and current information during registration and keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Types

We offer different account types including:

• Basic User Accounts - For pilots seeking AMEs/DPEs
• Claimed profile owner accounts - For eligible AMEs/DPEs or authorized office staff who complete ownership verification
• Administrative Accounts - For platform management

4. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Post false, misleading, or fraudulent ratings or reviews
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems to access the Service without our permission
• Interfere with or disrupt the Service or servers
• Collect or harvest user data without permission
• Upload malicious code or viruses
• Attempt to claim, purchase, manage, or alter a professional profile you do not own or control

5. Content

5.1 User-Generated Content

Users may submit ratings, reviews, and other content ("User Content"). You retain ownership of your User Content, but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content in connection with the Service.

5.2 Content Standards

User Content must:

• Be accurate and based on genuine experiences
• Not contain defamatory, offensive, or inappropriate material
• Not violate any third-party rights
• Not contain personal health information about others
• Comply with all applicable laws

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice and at our sole discretion. If you believe a review violates our content standards, you may report it or submit a dispute through our Review Disputes & Content Removal process. Removal decisions are made at our discretion.

5.4 Enhanced Profile Content

Claimed owners with active Enhanced access may submit supplemental content such as photos, biographies, website and booking links, office details, services, pricing, equipment, and availability. That content must be accurate, non-misleading, and authorized by the profile owner. FAA-sourced listing fields remain separate and read-only. We may edit, reject, suspend, or remove supplemental content at our discretion.

6. PIREPs, Ratings, and Reviews

6.1 Nature of Reviews

PIREPs (Pilot Reports), ratings, and reviews posted on our platform are subjective opinions of individual users based on their personal experiences. They do not represent the views of AME Foresight and should not be considered as objective facts or professional recommendations.

6.2 Third-Party Review Content

PIREPs, ratings, and reviews are provided by third-party users. To the extent provided by applicable law, AME Foresight is not treated as the publisher or speaker of information provided by another information content provider under Section 230 of the Communications Decency Act (47 U.S.C. § 230). We may still moderate, hide, or remove content under these Terms, and those actions do not make us the author of user-submitted reviews. We do not:

• Verify the accuracy or truthfulness of reviews
• Investigate the qualifications of reviewers
• Endorse any opinions expressed in reviews
• Guarantee that reviews are representative of all experiences

6.3 Review Guidelines

While we encourage honest feedback, users posting reviews must ensure their content is truthful, based on actual experience, and complies with our content standards. A new rating at any star level must include a written PIREP meeting the same minimum-content requirement. Defamatory, false, inauthentic, duplicate, or malicious reviews may be hidden or removed from public view and may result in account termination.

6.4 Response Rights

An AME or DPE with a Claimed Profile may publish a response to a review. A response does not alter the original review or guarantee its removal. AME Foresight is not responsible for mediating disputes between users and examiners.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by AME Foresight and are protected by international copyright, trademark, and other intellectual property laws.

8. Claimed and Enhanced Profiles

8.1 Claim Verification and Eligibility

A free Claimed Profile confirms that the AME, DPE, or authorized office staff completed our available ownership-verification process. Claiming does not permit changes to FAA-sourced listing fields. Payment alone does not establish ownership or profile-control rights.

8.2 Enhanced Profile Billing

Enhanced Profile access is a separate optional paid or complimentary feature set. It may be active independently of a Claimed badge and does not itself establish ownership. Paid Enhanced Profiles are subscription products billed through a third-party payment processor such as Stripe. By subscribing, you authorize recurring charges at the selected billing interval until cancellation takes effect under the applicable billing terms.

8.3 No Review Suppression or Hidden Endorsement

A Claimed or Enhanced badge does not remove public reviews, affect review-moderation standards, or constitute endorsement by AME Foresight. Listings with optional paid or complimentary Enhanced features may appear before standard listings and are identified as featured where that placement is used. Featured placement does not indicate examiner quality or an AME Foresight recommendation.

8.4 Expiration, Cancellation, and Revocation

When paid or complimentary Enhanced access ends, Enhanced photos, biographies, links, office details, services, pricing, availability, request forms, priority presentation, and detailed analytics are no longer displayed or available for editing. The stored Enhanced content may be retained for later reactivation. The free Claimed Profile, public review responses, review QR code, and basic profile-view count remain available unless ownership is revoked. We may revoke a claim or suspend Enhanced access if verification fails, payment is delinquent, a claim is fraudulent, or owner-managed content violates these Terms.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

10. Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party websites or services.

11. Disclaimers

11.1 Medical Disclaimer

The Service provides information about medical examiners but does not provide medical advice. Always consult with qualified healthcare professionals for medical decisions.

11.2 Accuracy of Information

While we strive to provide accurate information, we do not guarantee the accuracy, completeness, or timeliness of information on the Service, including FAA data and user reviews.

11.3 No Endorsement

Listing on our platform does not constitute an endorsement of any AME or DPE. Users should conduct their own due diligence when selecting a medical examiner.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AME FORESIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

13. Indemnification

You agree to defend, indemnify, and hold harmless AME Foresight, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

15. Governing Law

These Terms are governed by applicable United States law and, where state law applies, the laws of the state where AME Foresight is organized or principally operates, without regard to conflict-of-law rules.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
